In this text, the term “Website” refers to the website whose details are given above; the terms “Rainwater”, “we” and “Data Controller” refer to the company whose details are given above.
This text has been prepared, under Law No. 6698 on the Protection of Personal Data (“KVKK”) and Law No. 6563 on the Regulation of Electronic Commerce, in order to obtain your explicit consent to the sending of commercial electronic messages to you for the purposes of campaigns, announcements, promotions, information and marketing, and to the processing of your personal data in this context. This explicit consent is optional: the consent checkbox on the forms is unticked by default, and not giving consent does not prevent you from submitting an information, quote or service request.
1. Scope of Explicit Consent and Purposes of Processing
If you tick the relevant checkbox on the information and quote form or the service form on the Website, your first name, surname, telephone number, email address, province and commercial electronic message consent records may be processed by the Data Controller for the following purposes:
- Sending campaigns, announcements, newsletters and promotions relating to products and services,
- Presenting offers, benefits and information tailored to you,
- Sharing announcements of events, trade fairs, launches, new products or new services,
- Conducting satisfaction, feedback and customer experience processes,
- Storing and managing commercial electronic message consent and opt-out records.
2. Commercial Electronic Message Channels
If you give explicit consent, commercial electronic messages may be sent to you by email, SMS, telephone call and WhatsApp. Before any commercial messages are sent, your consent will be registered with the Commercial Electronic Message Management System (İYS), as required by law.
3. Transfer of Personal Data
Your personal data may be transferred, limited to the purposes above and to the extent necessary, to our service providers offering message delivery infrastructure (email and SMS) and customer relationship management services, to the Commercial Electronic Message Management System, and to authorised public institutions and organisations. Where the servers of the service providers used are located abroad, the transfer is carried out in accordance with the conditions set out in Article 9 of the KVKK.
4. Withdrawal of Explicit Consent and Right to Opt Out
You may withdraw your explicit consent and your permission for commercial electronic messages at any time, without giving any reason and free of charge. You can exercise this right by using the opt-out link in the messages sent to you, through the Commercial Electronic Message Management System (İYS), or by writing to [email protected]. Your opt-out request is processed within three working days at the latest and the sending of messages is stopped. Withdrawal of explicit consent does not affect the lawfulness of processing carried out before the date of withdrawal.
5. Retention Period
Your commercial electronic message consent records are retained for as long as your consent remains valid and, after your consent is withdrawn, for the period required by law (3 years); at the end of this period they are deleted, destroyed or anonymised.
6. Declaration
By ticking the relevant checkbox on the Website, you accept that you have read and understood this text and that, of your own free will, you give explicit consent to the processing of your personal data and to the sending of commercial electronic messages to you within the scope set out above. Further information on the processing of your personal data and your rights can be found in the Privacy Notice (KVKK).
